Dear non-Bulgarian participants,

The contents of this post is a part of the in-game reality. Some of you - leaders of groups we know, will receive it in an in-game manner, just as leaders of Bulgarian clans did or are about to, and decide if they actually need to know and/or to spread this detailed information. However, as these laws are published in the Bulgarian section of the forum as part of the information on the Heralds of Chaos clan, I felt that it is good to put you in an equal position so to say - hence this post. Please be informed, that you are in no way obliged to read, know, less of all memorize this information. It is  provided because the game may develop in a way that you might need it (or may not). It is a part of the setting, which will be published soon (I need time for the translations).

Also, please mind that the translation may not be always perfectly accurate. In cases where there are differences between the original Bulgarian text and its translation, the original text has precedence :P

Organic Law of the lands governed by the Heralds of Chaos

Article 1
Governance in the land of the Heralds of Chaos is based on the following principles:

- Respect for the freedom and rights of every inhabitant;
- Equality of all residents before the law regardless of their origin, sex, religion, clan affiliation, social status, property status and beliefs;
- Supremacy of the Organic Law;
- Self-governance of local communities and solving all issues related to the organization of everyday life at the lowest possible level.

Article 2
(1) The form of government in the land of the Heralds of Chaos is a constitutional aristocracy, where power derives from the Law.
(2) Supreme power is exercised by the Heralds of Chaos.

Article 3
(1) Fundamental rights and duties of the residents in the land of the Heralds of Chaos:
1. Everyone has the right to life.
2. No person living in the land of the Heralds of Chaos can be subjected to torture or to cruel, inhuman or humiliating treatment.
3. Everyone has the right to liberty and privacy. Nobody can be arrested or subjected to search, except in cases involving:
- Court hearing on suspicion of committing a crime. The hearing of the legal court in these cases should be conducted within one day from the moment of detention. At the same time the legal court may order further detention if necessary to clarify the case. The total period of detention before pronouncing a final verdict by the legitimate judicial authority may not exceed one month;
- Prevention of a crime. In cases of detention to prevent crime the maximum period of detention is one day.
4. Everyone is entitled to free will. Nobody can be subjected to magical effect, which seeks to establish control over his will and / or to deprive him of consciousness for their actions. An exception is allowed only in cases involving:
- Court hearing on suspicion of committing a crime, subject to the rules of the preceding paragraph;
- Prevention of crime;
- Actions aimed at establishing the truth in court proceedings by a mage specially summoned by the legal court who acquires the status of court mage during the course of the case;
5. Nobody can be forced to plead guilty or be convicted solely on the basis of his confession.
6. Every defendant is presumed innocent until proven guilty, and its enactment by a legal court.
7. Nobody can be condemned for an act which was not declared crime at the time it was committed.
8. Limitations on the rights of the accused beyond what is necessary for the realization of justice are not allowed.
9. Property is inviolable. Without the consent of its occupant no one can enter or remain in it except in cases of preventing crime, detaining a criminal and other cases of extreme necessity.
10. The freedom and secrecy of communications are inviolable. Exceptions to this rule are allowed only with permission of a legal court when required to detect or prevent crime.
11. Every inhabitant of the land of the Heralds of Chaos has the right to freedom of movement within their territory, to choosing their residence, leaving their borders and to returning back.
12. Freedom of conscience, thought, convictions and religious beliefs is inviolable. No one shall be persecuted or restricted in his rights because of their beliefs, nor shall be obligated or forced to provide information on their own or other’s beliefs.
13. Everyone is entitled to their opinion and to publicize it through words - written or oral.
14. Property rights and right of inheritance are inviolable.
15. Everyone has the right freely and without restriction to learn and practice magic.
16. Everyone has the right to own and bear arms.
17. Residents have the right to peaceful meetings and demonstrations.
18. Residents have the right to lodge complaints, proposals and petitions to local authorities and the Heralds of Chaos.
19. All these rights apply equally to all residents of the lands of the Heralds of Chaos, regardless of their origin, sex, religion, social status, property status and beliefs.
20. All these rights apply to foreigners residing in the lands of the Heralds of Chaos.
21. None is entitled to abuse these rights and the freedom to exercise them to the detriment of the rights of others.
22. All residents of the land of Heralds of Chaos, and all foreigners staying in their territory must abide by this Organic Law.
23. All residents of the land of Heralds of Chaos are required to pay taxes set by the authorities, according to the Law on Taxes and Trade, and within the limits prescribed by this Organic Law.

Article 4
The crimes, respective punishments and the rules governing court hearings are described in the Law on Trials and Punishments.

Article 5
The method of determining and collecting taxes and rules for doing business are described in the Law on Taxes and Trade.

Article 6
(1) The Heralds of Chaos act as the supreme power within their lands having the following prerogatives:

1. To adopt the Organic Law and amendments thereto.
2. To adopt the Law on Trials and Punishment and the Law on Taxes and Trade, applying throughout the lands they govern. These laws can not contradict this Organic Law.
3. To rule on the compliance of local ordinances and laws to this Organic Law.
4. To determine the taxes for the population of the free towns and villages as well as the feudal lords, amounting to up to 1/20 of the income or yield of the population of the free towns and villages, and to 1/10 of the income of feudal lords.
5. To divide the territory of the free towns and villages they govern into judicial districts and appoint judges who decide cases in those districts abiding by this Organic Law and the Law on Trials and Punishments.
6. To act as supreme judiciary for the free towns and villages as well as the family fiefdoms.
7. To act as regular judicial authority in respect to foreigners within the lands governed by the Heralds of Chaos.
8. To maintain postal services throughout the lands they govern.
9. To maintain roads between the major towns and castles throughout the land governed by them as well as their safety.
10. To ensure foreign security and independence of the land they govern.
(2) Interference of the Heralds of Chaos in preservation of internal order is permissible only:
1. to maintain order and ensure safety on the roads between major towns and castles;
2. upon request of a Town of Village Council or a feudal ruler, for their respective territory;
3. in cases of crimes that are organized and / or committed in more than one county or fief;
4. in cases of riots as a consequence of which the authority of the respective urban or rural council or feudal lord has been forcibly taken away;
5. in an officially declared state of war.

Article 7
(1) Units of local self-government in the land of the Heralds of Chaos are the free towns and villages and the family fiefs.
(2) Free towns and villages are those towns and villages that do not fall within the boundaries of any fiefdoms, welded from the time of the reign of His Majesty the King of the Seven Hills.
(3) The free towns and villages as units of local self-government include the territories of the respective town or village together with their adjacent territory according the maps and registers as registered by  the chancellery of His Majesty the King of the Seven Hills.
(4) The residents of the free towns and villages are entitled to elect Town or Village Councils to manage the affairs of the local communities. Elections for members of the Town / Village Councils are held every two years on basis of universal, equal and direct suffrage of all residents aged 16 years, by secret ballot.
(5) Town/village councils govern the affairs of the local community by:
1. adopting local regulations governing the life of the community;
2. solving current issues related to the life of the community;
3. electing among its members a mayor who speaks for the Council, and bestowing on him, in its sole discretion, the power to take decisions with regard to running the life of the community;
4. determining the local taxes, within a limit of an up to 1/10 of annual income or yield of the population.
5. recruiting and maintainimg local militia to protect the internal order.
(6) The family fiefdoms include the castles and territories subject to the power of the hereditary aristocracy, as granted by the will of His Majesty the King of Seven Hills up to the date of signing of the Treaty between the Kingdom of the Seven Hills and the Heralds of Chaos, along with the towns and villages falling into these territories.
(7) The family fiefdoms are run from their respective feudal lords, according to the customs and traditions established, however strictly observing this Organic Law.
(8) The Lords of the family fiefdoms govern the affairs of the population on the territory of the respective fiefs by:
1. adopting or approving local regulations governing the life of the community;
2. solving current issues related to the life of the community;
3. granting permission for election of  Town or Vilage councils and determining the extent of their powers;
4. exercising judicial power within the respective territory, with accordance to this Organic Law;
5. levying up to one tenth of the annual revenue or yields of the population;
6. recruiting and maintaining local militia to protect the internal order.
(9) The right of ownership over the family fiefdoms is inviolable, except in cases of violation by the feudal lord of this Organic Law. Cases of violation shall be tried by the Heralds of Chaos in an open and fair trial conducted according to the requirements of the Law on Trials and Punishment. In cases of proven violation of the, the feudal lord shall be deprived of property rights on the fief, except the title to his castle, and the settlements within the fief shall acquire the status of free townd or villages.

Article 8
The Heralds of Chaos are not privileged in comparison with the other residentsof the lands they govern. They can be investigated and prosecuted for violations of local laws to the territories in which they live, this Organic Law and the other laws applicable throughout the  lands they givern, under the rules and procedure provided for in this Organic Law and the Law on Trials and Punishment.

Article 9
(1) The mayors elected by the Town and Village Councils and the feudal lords form a Supreme Assembly with the following powers:
1. To propose amendments to this Organic Law and other laws applicable throughout the lands managed by the Heralds of Chaos. Heralds of Chaos are obliged to consider any proposal for amendment of laws that is adopted by more than a half plus one vote of the present members of the Supreme Assembly. The Heralds of Chaos are obliged to accept any proposal for amendment of laws adopted by a three fourths of the present members of the Supreme Assembly.
2. To act as the supreme judiciary for crimes in which the defendant is a member of the Heralds of Chaos.
(2) Proposals for amendments to laws adopted by the Supreme Assembly may not apply to:
1. changing the form of government;
2. revocation of rights and freedoms of the population established by this Organic Law;
3. Change of property.
(3) The meetings of the Supreme Assembly are legitimate if attended by at least half of its members.

Article 10
This Organic Law is supreme and other special and local laws can not contradict it.

Law on Trials and Punishment

Article 1.
(1) This Law applies to all offences committed in the land of the Heralds of Chaos, and crimes committed on foreign territory where the victim of the offence or the attempted  offence is a member of the Heralds of Chaos or a resident of the land of the Heralds of Chaos.
(2) Immunity with respect to this Law shall be possessed only by foreigners for which a request for Ambassador status has been made by a formal letter and such status has been granted, which shall be certified by an official document.

Article 2.
(1) An offense is any act that is committed intentionally or negligently, and declared by this Law as such.
(2) No criminal action shall be considered committed in self-defense, protection from harm to another or defense of attacked property, by causing damage to the attacker within the necessary limits.

Article 3.
(1) any attempt to commit an offense shall be punished with the punishment provided for that offense, taking into account the extent of its implementation and the reasons why it remained unfinished.
(2) an attempt to commit an offense shall not be punished if the offender, on his own motive, decided to not complete the offence or prevented the occurrence of consequences.

Article 4
No punishment shall be enforsed on a person who:
1. planning and/or committing the offense has acted under the influence of magic or curse imposed on him by another without his knowledge or consent;
2. suffers from a mental infirmity, due to which he or she does not understand the meaning of the act;
3. has restored the factual circumstances subject or related to the  subject of the offence as they were prior to the moment of committing the offense, in case no permanent harm has been caused to the victim or to other persons.

Article 5
(1) Trial and the imposition of punishments for offences shall be carried out by designated courts as follows:
1. For residents of the land of the Heralds of Chaos - by the district judges appointed by the Heralds of Chaos for each judicial district;
2. For foreigners, accused of committing an offence on the territory of the Heralds of Chaos or an offence against a member of the Heralds of Chaos or a resident of the lands governed by the Heralds of Chaos - by a jury consisting of three representatives of the Heralds of Chaos
3. For members of the Heralds of Chaos – by a jury consisting of five representatives of the Heraldsof Chaos. The accused person may not be a member of this jury.
(2) A jury of three members of the Heralds of Chaos serves as the appellate court in the cases under para. 1, item 1
(3) Decisions of the jury under par. (1), items 2 and 3 and paragraph (2) are final.

Article 6
(1) All juries under the previous article hold trial to establish the guilt or innocence of the accused and the determine a punishment to those declared guilty.
(2) In each trial at least one representative of the prosecution and at least one counselor of the defendant(s)  must participate to submit their theses and evidence, including calling witnesses before the jury. The jury decides on guilt or innocence of the defendant after hearing the representatives of the prosecution and defense and its witnesses. The jury decides on the punishment of convicted offenders at its discretion, with accordance to this Law.
(3) Every defendant has the right to select and designate a counselor (advocate) without limitation, the sole requirement being that the counselor is in position to appear to participate in the trial within a reasonable period of time.
(4) In cases where the defendant does not appoint a counsel, his selected counselor refuses to participate in the meeting, or may not appear to participate in the meeting within a reasonable period of time or is momentarily unable to attend the meeting, the jury determines another counselor in its own discretion.

Article.7
(1) The punishments are:

1. Death
2. Exile
3. Confiscation of property
4. Fine
5. Forced community service

(2) The manner of execution of death sentences and follow-up acts with regard to the soul and body of the convict shall be determined by the judge or jury in accordance with the gravity of the offense, the circumstances in which it was committed and the degree of regret and cooperation of the convict.

Article 8.
(1) Whoever, in order to change the existing form of government in the lands of Heralds of Chaos, involved in the commission of attempted forcible seizure of power, is punishable by death and confiscation of property or exile and confiscation of property.
(2) Whoever incites another clan or faction or group into a war or other hostile act against the Heralds of Chaos, their lands and/or the people living in them, or takes any action to cause a war or other hostile act against the Heralds of Chaos their lands and/or people living therein, is punishable by death and confiscation of property.
(3) Any  revealing or collecting in order to reveal to another clan or faction or group information related to the military security of the Heralds of Chaos, their lands and/or people living therein, is punishable for espionage by death and confiscation of property.
(4) Any person who deliberately commits a magical act intended to restrict the freedom of  will of another is punishable by death or forced community service.
(5) Any person who by a willful act restricts or attempts to restrict the freedom of conscience, thought, convictions and religious beliefs and the right of free expression and dissemination of opinion, is punishable with exile.
(6) Any person who by a willful act violates the confidentiality of communication is punishable by compulsory community service or a fine.
(7) Any person who deliberately kills another is punishable for murder by death.
(8) Whoever intentionally causes serious bodily harm to another is punishable by death.
(9) Whoever violates the privacy of another's home or temporary habitation by using force, intimidation, stealth, agility, abuse of authority or magic, is punishable by compulsory community service or a fine.
(10) Whoever takes hold of property possessed by another without his consent by using force, intimidation, stealth, agility, abuse of authority or magic, is punishable for theft with compulsory community service.
(11) Whoever destroys or damages another's property is punishable by compulsory community service and a fine.
(12) Whoever draws a false document or forges the contents of anofficial document is punishable by compulsory community service or fine.
